Gold Coast mortgage broking firm and its director have been fined a total of $24,000 for failing to pay three financial consultants any wages for almost two months work.
Dracook International Pty Ltd was fined $20,000 in the Federal Magistrates Court in Brisbane yesterday and ordered to back-pay the workers a total of $13,644 in wages, annual leave entitlements and interest.
Dracook International owner-manager Robert Cooke was fined $4000 after he admitted his involvement in the underpayments.
Cooke contracted the three underpaid consultants to work full-time for Dracook International from 11 March, 2008 - but the men resigned on 2 May because they had not been paid.
Yesterday’s fines and underpayment order are the result of a prosecution by the Fair Work Ombudsman.
Fair Work Ombudsman Queensland Director Julie Wade says the case should serve as a warning that individuals, as well as companies, who breach workers’ rights will be held accountable.
“We will not hesitate to pursue individuals who do the wrong thing by their employees,” Ms Wade said.
The Fair Work Ombudsman promotes harmonious, productive and co-operative workplaces. It also monitors compliance and investigates breaches of national workplace laws.

Robert Cooke has shown his true colors. He has morphed into the person he once despised, a businessman who couldn't stand and face what he caused. His brother in-law, Brad was once berated for opting out of a Bakers Delight Franchise in Brisbane and not having the business acumen to succeed. Robert took the opinion that he failed for this reason. Robert has opted for a cowardly approach in his business failings by hiding from creditors. How the tide has turned. Brad can hardly wipe the smirk off his face.
ReplyDeleteHe owes much more than the fines and back wages combined to me. I now intend to recover it by exposing him wherever I can. I may not recover the money invested. Simply knowing that he is being exposed will go some way towards healing the deceit. At least in the Workplace Ombudsmans' case he has been prosecuted. He has the attitude that he has done nothing wrong and he is beyond reproach. He has been hiding from his creditors and this shows the power of the Workplace Ombudsman to track him down.

He used to live in a big house on the water at 55 Lindsay parade Paradise Waters. Rented of course, just had to look like a big shot. Last I heard he then moved across the road to a small unit behind another place with a longer driveway if this helps anyone get there money back.
